Acceptance of Terms

By accessing or using Fluctur (“the Service”), you agree to comply with and be bound by these Terms of Service. If you do not agree, please discontinue use of the Service.

These Terms work together with our Privacy Policy and Community Guidelines to govern your use of Fluctur.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree that any activity occurring under your account is your responsibility. Notify us immediately if you suspect unauthorized use.

Use of Service

You agree not to misuse the Service. Prohibited activities include:

• Uploading malicious content
• Violating any applicable laws
• Infringing on intellectual property rights
• Disrupting the Service

Intellectual Property

All content and materials are the property of Fluctur or its licensors. You may not reproduce, distribute, or create derivative works without permission.

Managing Your Subscription

You can sign up for a free or paid subscription plan, including trials or promotional offers. Your plan begins when you accept these Terms and continues until you cancel or we terminate your account. By initiating your first subscription payment, you authorize us to charge recurring fees to your payment method. Unless you notify us of your intent to cancel before your renewal date, you acknowledge your subscription will automatically continue, and you authorize us to charge your payment method for the applicable fees and taxes on each renewal date.

We may change or modify subscription plans, including adding or removing features or adjusting pricing. If changes materially impact your subscription, we will provide reasonable advance notice. If you continue to use the Service after changes take effect, you agree to the updated terms. If you do not agree, you may cancel your subscription.

If you cancel a paid plan, it will continue until the end of your current billing cycle and then convert to a free plan. To cancel, visit your billing settings. Payments are generally non-refundable unless required by law. However, if you cancel within 72 hours of starting a paid plan, we may, at our discretion, issue a refund.

If you permanently delete your account, all content will be removed, and you will not be able to reactivate it.

Payments and Refunds

Refunds may be issued under the following circumstances:

• The Service was not delivered as described.
• Technical issues persist after a reasonable effort to resolve them within 14 days.
• The purchase was made in error and the refund request is submitted within 7 days.

Refunds are assessed on a case-by-case basis and are issued at our discretion.

Community Standards

You agree to comply with our Community Guidelines, which describe prohibited content and behavior. Prohibited content includes but is not limited to:

• Adult content and pornography
• Hate speech or harassment
• Extremist or terrorist content
• Illegal goods and services
• Child exploitation or abuse
• Self-harm or suicide promotion
• Shocking or violent content
• Spam, fraud, and deceptive practices
• Misinformation
• Privacy violations and impersonation

Suspension or Termination of Your Account

We reserve the right to suspend or terminate your account, or limit your access to the Service, if you violate these Terms, our Community Guidelines, or other applicable policies. Depending on the nature and severity of the violation, we may take different measures, including switching your paid plan to a free plan with limited features, suspending access to monetization programs, or disabling your account.

We may also suspend or terminate your account if required by law, a court order, or if we reasonably believe this is necessary to protect you, us, other users, or third parties. While we will attempt to notify you before taking action, we are not obligated to do so in all cases.

If your account remains inactive for an extended period (for example, six months) and you are on a free or non-paying subscription, we reserve the right to close your account without notice.

If your account is suspended or terminated under this section, you will not be entitled to a refund for any fees paid, unless required by law. We are not responsible for any loss of content or functionality resulting from account suspension, termination, or downgrade.

If you believe your account was suspended or terminated in error, please contact us at [email protected]. We are committed to making good-faith efforts to resolve any issues before either party initiates legal action. We ask that you allow at least 30 days to work towards a resolution.

Feedback

We appreciate your feedback and ideas about how we can improve Fluctur. If you share suggestions with us, you agree that we are free to use them without any obligation to compensate you.

From time to time, we may make beta or pre-release features available for you to test and provide feedback. You understand that beta features are still under development, may not be reliable, and may change at any time.

Privacy

At Fluctur, safeguarding your privacy and that of your visitors is a priority. Our Privacy Policy outlines how we collect, use, and protect your personal data. By using Fluctur, you agree to the practices described in the Privacy Policy.

If you are located in a region where data processing agreements (DPAs) are required (for example, under the GDPR), our DPA is incorporated into these Terms by reference. By creating an account, you confirm that you have read, understood, and consented to it if applicable.

All data, including any intellectual property rights associated with it, that we generate from your use of the Service or content (“Data”) is owned by Fluctur. As part of the Service, we may provide you with Data or analytics derived from it (“Data Analytics”). While we strive to ensure the accuracy of Data Analytics, we do not guarantee their completeness or accuracy.

Modifications to Terms

We may update these Terms periodically. Continued use of the Service constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of Turkey, without regard to conflict of law principles.
